Borges Lettering is an independent type foundry and lettering studio that designs and sells original digital typefaces and digital design tools. We operate borgestype.com and deliver our products electronically as digital downloads.

You may use this Site for lawful purposes only. You agree not to:

• Use the Site in any way that violates applicable federal, state, local, or international law
• Attempt to gain unauthorized access to any portion of the Site, our servers, or any connected system or network
• Reverse engineer, decompile, or attempt to circumvent our font protection system (BT Protect) or any digital rights management measures
• Use automated tools, scrapers, or bots to access or copy content from the Site without our written permission
• Transmit any material that is defamatory, offensive, or otherwise objectionable

What You Are Buying

When you purchase a font from Borges Lettering, you are purchasing a license to use the font software, not ownership of the font itself. All fonts remain the intellectual property of Borges Lettering.

License Scope

Unless otherwise specified at the time of purchase, each font license is a non-exclusive, non-transferable license for personal or commercial use, limited to the number of seats purchased, and limited to desktop/print use unless you have purchased a specific web, app, or broadcast license.

Prohibited Uses

You may not redistribute, resell, sublicense, or share font files; modify or create derivative font software; use our fonts to design a competing product; or remove embedded copyright or license information.

Digital Delivery

Font files are delivered electronically via download link following purchase confirmation. It is your responsibility to download and back up your files.

Our Type Tester and Font Showcase widgets are provided as complimentary tools to help you evaluate our fonts.

• Font data delivered through our preview tools is encrypted and licensed for preview purposes only. You may not use browser developer tools or any other method to extract font data from these tools.
• The tools are provided “as is” and we make no guarantee of uninterrupted availability.
• We may modify, suspend, or discontinue any digital tool at any time without notice.

All prices are listed in US Dollars. We reserve the right to change prices at any time. The price you pay at the time of your order is final for that transaction. Payments are processed by third-party payment processors. By submitting payment information you represent that you are authorized to use the payment method provided.

Because our products are digital downloads delivered immediately upon purchase, all sales are final. We do not offer refunds or exchanges on font licenses once the download link has been accessed.

Exceptions may be made at our sole discretion for duplicate accidental purchases or a product that is materially defective and cannot be remedied by a replacement file. Contact us within 14 days of purchase at support@borgestype.com with your order number.

All content on this Site — including font designs, type specimens, lettering artwork, the BT Protect delivery system, the Type Tester and Showcase widgets, logos, trademarks, and written content — is the property of Borges Lettering or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, display, or create derivative works from any content on this Site without our prior written permission, except as expressly permitted by your font license.

THE SITE AND ALL PRODUCTS AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, BORGES LETTERING DISCLAIMS ALL WARRANTIES INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE FULLEST EXTENT PERMITTED BY LAW, BORGES LETTERING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR OUR PRODUCTS. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless Borges Lettering and its officers, employees, and agents from and against any claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising from your use of the Site, your violation of these Terms, or your infringement of any rights of any person or entity.

These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-law provisions. Any dispute arising from these Terms shall be resolved in the state or federal courts located in Washington, and you consent to the personal jurisdiction of such courts.

We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised Effective Date. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
